The process of hiring a lawyer for a divorce or parentage matter seems simple – a consultation, retention and representation. But what most husbands, wives, fathers and mothers don’t understand is the beginning of the process is like a domino to nearly everything that follows. If the initial consultation is missing certain, critical elements, the path you head down may not be the best and, like many poor starts, may cause unnecessary delays, money and even affect the results.
Strategy – In our experience, it’s a word too many family law attorneys do not take seriously and do not execute in their clients’ representation. Instead, we see too many lawyers focused on “reacting” to what happens while a case ages and doesn’t make the forward progress it should.
When does strategy start? In a divorce or parentage case, pre or post judgment, before you file the first document with the court or serve it on your spouse or other parent.
Does family law strategy really occur at a “consultation?”
I know plenty of lawyers who offer a “consultation.” Some of them are focused on one thing at consultation – selling the client to retain. Is that what you want? To be “sold” on the lawyer? Or are you there to get answers to questions, discuss strategy and figure out how you should proceed forward.
Look, I am not stating all consultations are a waste of time. I am sure there are some lawyers who take the time to actually listen to the prospective client and answer the questions.
